General Terms and Conditions for the Use of IMMOOZ.COM Services

To use the IMMOOZ.COM services, please read these general terms and conditions carefully as they contain important information about your rights, obligations, and the remedies available to you.

Preamble
IMMOOZ.COM provides its Services to businesses and individuals subject to their full and unreserved acceptance of these general terms and conditions of use (hereafter “Terms of Use”), without prejudice to the specific terms of use for different Services.

1 – Definitions

Review: expression of a consumer’s opinion on a theme related to the subject judged, through various qualitative or quantitative evaluation elements or a work, which the consumer has experienced, whether they were the buyer (if the item is paid) or not. A consumer review consists of information related to personal consumption experiences. This review is intended for individual public release. A Review on the IMMOOZ.COM site thus relates to comments (Rating, Review, and if necessary, any supporting document of the consumption experience for which the User owns and/or holds usage rights) written and posted by Contributors in the Services when their functionalities allow.

Collection: the collection of consumer reviews refers to all means of gathering consumer opinions.
Conflict of Interest: situation (i) either where the Contributor is a person, professional or not, who has interests related to the evaluated subject that could influence the independence of their review, (ii) or where the IMMOOZ.COM company or its employees use directly or indirectly methods of processing consumer reviews based on their commercial or private interests, contributing to biasing the return of reviews.
Company Content or Content: refers to all information and/or data provided by the company when completing the registration form. This also includes Reviews, Photos, or Personal Data.
Experience Date: date on which the consumer fully used the product or service, whether it is simply declared or can be determined objectively.
Release Date (or publication date): date corresponding to the display of the Review – for consultation by Users on the IMMOOZ.COM site after Moderation.
Personal Data, or Personal Information: refers to all information about an identified or identifiable legal person. These are in particular the data that the company communicates or provides on the registration form.

Right of Reply: opportunity offered to the Professional to respond to a consumer review concerning them and to which they are authorized to reply.
Moderation: moderation refers to the operations of automated filtering, analysis, human reading for an acceptance, leading to a publication or a rejection of a consumer Review or Comment. Moderation can also intervene for the removal of an already published consumer Review. Moderation can be wholly or partially automated or human (via a Moderator). It must be done in advance (prior moderation): the consumer review is moderated before being published. It can be done afterward (post-moderation): the consumer review is published and moderated after publication.

Rating: rating allows a consumer to give their opinion based on a scale of appreciation.
We or IMMOOZ.COM: refers to IMMOOZ.COM, the publisher of the real estate portal services.
Expiration of a Review: state of a consumer review which results in this Review no longer reflecting the current characteristics of the evaluated product or service.

Photos: photos in JPEG or PNG format, deposited as part of the gallery section.

Professional(s): refers to any professional (individual or legal entity) who appears in the response lists of the IMMOOZ.COM website, whether they are advertisers or not.

Service(s): refers to any service offered on IMMOOZ.COM that requires registration or a contract to benefit from all the features offered by the service(s).

2 – Purpose

The purpose of these Terms of Use is to define the rights and obligations of professionals in the context of using IMMOOZ.COM Services. They come into effect on the date they are posted in the Services and are binding from the date of the first use of the concerned Service by the User, throughout its duration, through the active approval of the Terms of Use, upon registration.

3 – Duration

The use of the Services is indefinite, and IMMOOZ.COM can terminate it at any time. The professional can at any time renounce using the Services. The Terms of Use are binding on professionals for the entire duration of the concerned Service until new General Terms and Conditions replace them.

4- Creation or registration in the listing

The provision of this Personal Data and its up-to-date maintenance are one of the decisive conditions for the right to use the Services.
The professional remains free to modify, at any time, the content of this Personal Data, according to the procedures referred to in the “Personal Data” article below.
The professional undertakes that the information and/or data they communicate during their registration does not infringe the rights of third parties and, in particular, that they are not unlawful and/or contrary to public order.

5 – Terms of use: special mentions for the consumer review service

Presentation of the Review and Comments service
The consumer review service allows internet Users to consult and submit Reviews.
To avoid any conflict of interest, all operations of Collection, Moderation, and Return of Reviews carried out by IMMOOZ.COM are (i) completely independent of any advertising space purchase operations or product and service sales carried out by Professionals on or from the www.IMMOOZ.com website carried out to ensure total fairness in the treatment of deposited Reviews, to ensure the reliability of the Review Service.
As part of the review reliability process (post-moderation or additional surveys), IMMOOZ.COM reserves the right to contact the Contributor by email and/or phone to verify the authenticity of the Review.

Accepted supporting documents are those likely to provide additional information on the consumer experience of the IMMOOZ.COM user with the Professional. Examples: establishment photos, invoice, receipt …
Moderation-validated supporting documents are kept by IMMOOZ.COM for 13 months from their validation date and can be used as part of checks and investigations on review reliability.

Reasons for rejecting a Review:
• Not detailed enough: the Review does not provide enough details proving a personal consumption experience.
• Unintelligible: the Review is not understandable.
• Does not respect the General Terms of Use and the Editorial Charter: the review does not respect the editorial charter and the present General Terms of Use.
• Off-topic: the Review is not related to the commented Professional.
• Personal data: the Review contains personal data.
• Unlawful Review: the content of the Review is against the law (content with anti-Semitic, homophobic, pornographic, racist characters …).
• Abusive Review: the Review contains hurtful, excessive, or insulting words.
• Review related to IMMOOZ.COM: the review is intended for the IMMOOZ.COM brand and/or the SFD partner sarl group and not for internet users.
• Duplicate: a similar Review has already been written and published.
• Review related to justice: the review refers to the legal situation of the professional.
• Defamatory review: contains words that harm the professional’s honor.
• Health-related review: the review refers to health data.

IMMOOZ.COM provides no guarantee and disclaims all responsibility for the content of the Reviews, including the accuracy or reliability of the information therein, and the quality of the people, products, services, or information, whatever they may be, presented, purchased, obtained, or contacted through a Review. Review consultation is done at the sole responsibility of the Users who assume all risks that may arise.

The User consulting the Reviews acknowledges that their content was written and/or published by the individuals who submitted them, and in no way reflects the ideas, opinions, or advice of IMMOOZ.COM.
The professional and the internet user guarantee, in this regard, IMMOOZ.COM against all actions and recourse of any nature whatsoever, related to their consultation.
Right of reply of the professional to a Review

The commented Professional can respond to a published Review on their detailed file. They write their response, and it is then posted on the descriptive file.
Like the Reviews, the responses are moderated in advance and afterward, and IMMOOZ.COM reserves the right not to publish a response if it does not respect the General Terms of Use and in particular the Editorial Charter.

The reasons for rejecting a Right of Reply are:
• Not detailed enough
• Unintelligible response
• Response not respecting the editorial charter
• Response with unlawful content
• Abusive response
• Defamatory response
• Off-topic response
• Response containing personal data
• Duplicate response
• Response related to IMMOOZ.COM

Depublication of Reviews
At the professional’s request: no request for deletion of an individual Review made by the Professional will be accepted by IMMOOZ.COM, unless the Review is considered abusive after new Moderation.
In the event of a move and/or change of owner: if IMMOOZ.COM is notified, by a User and/or a Professional, of a change of address or ownership of an establishment, all existing Reviews on the concerned Professional will be unpublished. IMMOOZ.COM reserves the right to request any proof in this regard.
During post-moderation and/or during checks as part of our quality policy, particularly aimed at authenticating online Reviews, IMMOOZ.COM reserves the right to unpublish a Review if, during the checks or during post-moderation, it is found not to respect the General Terms of Use.
If a review is considered “expired” compared to its Expiration Date: on IMMOOZ.COM services, Reviews published for more than 3 years are considered expired. Once the Reviews are deemed expired, they are fully unpublished from our services.

6 – IMMOOZ.COM Editorial Charter

IMMOOZ.COM is all of us, you the user, the professional, the individual, and us, the publisher!
By sharing your reviews on IMMOOZ.COM, you help the entire community make the right choice. On our side, we verify the information about professionals and do everything possible to make your recommendation as useful as possible. It makes the difference.

We are committed to doing everything possible to ensure the transparency and reliability of reviews.
Quality reviews are reviews useful to the community!

Our stance on your contributions
Everyone has the right to speak!
IMMOOZ.COM is open to everyone, so don’t hesitate to speak up when you feel like it.
Every review counts!
Positive or negative, every review is published, provided it reflects a genuine experience with a professional and is useful to the community.

The substance: your experience is everything!
Your review describes only your experience with a professional: the facts, but also your impressions.
There’s no need to dwell on what happened before and after or discuss unrelated topics.

The form: the quality of your content
Sharing a review means providing concrete and useful information to the entire community.
Your review should be well-written enough to be understood and detailed enough to be useful.

Let’s respect each other
Is your review negative? That’s your right! However, avoid any form of aggression or defamation towards the professional.
Some information must not be mentioned as they infringe on privacy rights and are against the law. In particular:
• Personal information: employee’s last names, websites, phone numbers, etc.
• Any ongoing or upcoming legal actions.

Do you have proof?
An invoice or a ticket can be attached to your review. To be considered, it must be legible and related to the experience you describe in your review. If your proof couldn’t be taken into account, you can’t send it again. Remember this for next time!

Your contribution wasn’t published. Why?
Your review might not be published. Don’t worry! Most of the time, a slight edit to your message will make it publishable. We explain our reasons here.

a – Your contribution must follow certain rules to be useful to the community
Only talk about the professional
Your review should reference the professional you selected, excluding all other subjects.
Express yourself clearly
Write clearly, with short and understandable sentences, avoid abbreviations, SMS language, or excessive punctuation (??? or !!! for example). Also, the rating you give to the professional should be consistent with the review you share.
Be precise and detailed
Your review should provide maximum information about your experience: its progress, your impressions, the positives, or negatives. The more precise and concrete your explanations, the more relevant and useful you’ll be! Also, give it a clear and explicit title to be well understood by the community!
Be authentic and sincere
An existing review cannot be copied/pasted. We’re interested in yours!

b – Your contribution poses ethical problems or is not compliant with the law
Your contribution contains personal data
Personal data aren’t published as they can infringe on privacy.
Your review shouldn’t mention phone numbers, addresses, emails, websites, employee’s last names, health data, etc. Similarly, your photo shouldn’t show license plates, contact details on a package, business cards, company trucks, health data, etc.
Your contribution challenges the professional and can be perceived as defamatory
You have every right to have a negative opinion. However, in writing your review, remain calm, objective, and moderate. Constructive criticism is more relevant and will be better understood. Avoid words such as “scammer”, “thief”, “crook”, “dishonest”, which give an aggressive tone to your words and can assimilate them to defamation. Regarding activities related to human health, your contribution must focus on the general reception you received from the practitioner, without being able to include judgment on the practitioner’s competence or the medical act itself.
Your review refers to justice
Whether it’s ongoing or upcoming legal proceedings, appeals, or court decisions, your review shouldn’t relay this information.

Your contribution is of an unlawful nature
Anti-Semitic, homophobic, pornographic, xenophobic, racist, discriminatory remarks, references to drugs, etc., are unlawful and cannot be published. The same goes for photos explicitly showing cigarettes, firearms, alcohol, drugs…

7- Consultation and uses

IMMOOZ.COM provides no guarantee and disclaims all responsibility concerning the content of photos/images, including their accuracy or the reliability of the information they contain, and the quality of the people, products, services, or information, any copyrights they might have, presented, purchased, obtained, or contacted via an image. Users assume all risks that may arise when viewing the images.

Users viewing the images recognize that their content was written and/or published by the individuals who submitted them, with IMMOOZ.COM acting as an intermediary relay, and in no way reflects the ideas, opinions, or advice of IMMOOZ.COM.

The User guarantees IMMOOZ.COM against any actions and recourse of any nature related to their consultation.
IMMOOZ.COM uses all reasonable means at its disposal to ensure access to the Services but is not obligated to succeed. IMMOOZ.COM reserves the right, without notice, to permanently or temporarily suspend the use of all or part of the Services, including for updates, modifications, maintenance, or for any other technical and organizational reason.
Consequently, IMMOOZ.COM’s liability cannot be held in any way or for any reason, especially in the event of a temporary or total unavailability of all or part of the Services, a difficulty related to response time, and generally, any performance defect of all or part of the Services. Use of the Services implies acceptance, without conditions, of the Terms of Use.
